Risk Disclosure
Last updated
Trading can cost you money, sometimes more than you planned to risk. Everything NexAlgo offers is for educational and informational purposes only and is not financial advice. This Risk Disclosure explains the main risks of trading and the limits of what NexAlgo offers. It applies to everyone who uses the Service, with or without a Subscription, and it forms part of our Terms of Service. Please read it before you subscribe and keep it in mind every time you trade. If you do not accept these risks, do not use the Service.
Who we are and what this covers
The Service is operated by NEXALGO LLC, a New Mexico limited liability company in the United States (“NexAlgo”, “we”, “us” or “our”).
“The Service” means nexalgo.com, your NexAlgo account, our indicators on OpenMarket (Nexalgo SMC, Nexalgo SM Oscillator and Nexalgo Ignition), your paid subscription to them (a “Subscription”), the guides, documentation, strategy playbooks, weekly chart analysis, Discord community and other content we make available to members (“member content”), and our support. This Risk Disclosure forms part of our Terms of Service. If the two conflict, the Terms of Service prevail.
The Service is only for people aged 18 or older.
Trading involves substantial risk
Trading stocks, forex, futures, options, CFDs, crypto assets and other instruments carries a substantial risk of loss. Prices can move fast and without warning. You can lose part or all of the money you trade with.
Only trade with money you can afford to lose. Do not trade with borrowed money, money you need for living costs, or savings you depend on.
Risks you should understand before you trade include:
- Volatility: prices can swing sharply within minutes, especially around news.
- Gaps: price can jump past a level without trading at it, for example over a weekend or after an announcement, so an order can fill far from where you expected.
- Liquidity: in thin markets you may not be able to enter or exit at the price you want, or at all.
- Costs: commissions, spreads, funding and other fees reduce every result and add up over many trades.
- Broker and exchange risk: a broker or exchange can go offline, freeze withdrawals, change its rules or fail.
- Rule changes: laws, taxes and exchange rules can change and affect open positions.
Leverage can cost more than your deposit
Futures, margin accounts, CFDs, some options strategies and leveraged crypto products let you control a large position with a small deposit. Leverage makes gains and losses larger.
A small price move against you can wipe out your deposit, trigger a forced liquidation or leave you owing your broker or exchange more than you deposited.
Before you use leverage, make sure you understand how margin, liquidation and funding work at your broker or exchange.
Crypto markets
Crypto assets trade around the clock, can be extremely volatile and are less regulated in many countries. Exchanges can be hacked, go offline, restrict withdrawals or fail, and the rules for crypto can change suddenly where you live.
Educational purposes only, no financial advice
Everything in the Service is provided for educational and informational purposes only. Nothing in it is financial, investment, trading, legal or tax advice, and nothing in it is a recommendation, an offer or a solicitation to buy or sell any security, commodity, currency, crypto asset or other instrument. It does not replace personal advice from a licensed financial adviser.
We do not know your finances, goals, experience or tolerance for risk, and nothing we publish takes them into account. That includes the indicators, guides, playbooks, weekly chart analysis, Discord messages and support replies. Support, including priority support in Complete, answers questions about how the indicators and the Service work; it does not review your trades, positions or account and does not tell you what or when to trade.
Not a broker or registered adviser
NexAlgo is not a broker, dealer, investment adviser or commodity trading advisor. We are not registered as any of these with the U.S. Securities and Exchange Commission, the Commodity Futures Trading Commission, the National Futures Association, any state regulator or any regulator outside the United States.
We do not manage money, place trades for you or connect to your brokerage or exchange accounts. Using the Service does not create an adviser, fiduciary or similar relationship between you and NexAlgo.
What the indicators are
Nexalgo SMC, Nexalgo SM Oscillator and Nexalgo Ignition are analytical tools. They read market data on your OpenMarket chart and display levels, zones, readings and signals to help you study the market. They do not know what price will do next.
Entry signals, stops, trailing take profit levels, fixed targets and reversal signals shown by Nexalgo Ignition are markings on a chart. They are not orders. A stop or target on your chart does not protect a position or close a trade. Only orders you place with your broker or exchange do that, and those orders can still fill at a worse price than shown.
Signals can be wrong, late or missing
No indicator is right all the time. Signals can be wrong, arrive late or not appear at all. A signal or level shown while a bar is still forming can change before that bar closes.
Results depend on the symbol, timeframe, settings, data source and market conditions. The same indicator can behave very differently across markets and timeframes, and an approach that worked in one period can stop working in the next.
Long losing streaks are possible, even if you follow every signal exactly.
Data, platform and alert issues
The indicators run on OpenMarket and rely on the price data OpenMarket receives from exchanges and data providers. That data can be delayed, incomplete, corrected later or wrong, and it can differ between providers, so the same symbol can show different results on different feeds.
Alerts and webhook alerts are OpenMarket features. Which ones you can use, how many and how quickly they arrive depend on your own OpenMarket plan and on OpenMarket’s systems. Alerts can be delayed, duplicated or not sent at all. Email, apps, phones and internet connections add their own delays and failures.
If you connect alerts to a trading bot, broker, exchange or any other automation, you do so entirely at your own risk. Automated orders can be placed in error, repeated or filled at bad prices, and they keep running when you are not watching. You are responsible for setting up, monitoring and securing any automation you use.
OpenMarket, TradingView and other third parties
OpenMarket is a separate platform. NexAlgo is independent and is not affiliated with, endorsed by or sponsored by OpenMarket. You need your own OpenMarket account, and your use of OpenMarket is governed by OpenMarket’s own terms.
TradingView is a separate platform too. NexAlgo is independent and is not affiliated with, endorsed by or sponsored by TradingView. If we give you access to the indicators there on request, you need your own TradingView account, your use of TradingView is governed by TradingView’s own terms, and the indicators rely on the price data TradingView provides. The points in this section apply to TradingView in the same way.
OpenMarket can change its terms, fees (including fees it charges for invite-only scripts), features or availability at any time, and it can suspend accounts or scripts, including your account and our own vendor account or scripts. If that happens, access to the indicators may be interrupted or limited, or we may deliver access in a different way. We may also pause or limit new Subscriptions or run a waiting list. Our Terms of Service explain how this affects your Subscription.
We are not responsible for outages, changes or decisions of OpenMarket, TradingView, brokers, exchanges, data providers, Discord or other services outside our control, or for any trading loss that results from them.
Simulated results have limits
Some results on our website come from simulations. A simulation applies fixed rules to historical prices to estimate what might have happened. It is a model, not a record of real trades, and it has built-in weaknesses:
- No real money was at risk. Real trading brings stress, hesitation and mistakes. People skip signals, exit early or change their plan. A simulation follows every rule without fail.
- It is made with the past in view. Rules and settings are chosen and reviewed on data that already exists. Settings that fit past data well can fail on new data.
- Costs and fills are assumptions. Real commissions, spreads, funding and slippage vary. A simulation can assume a fill at a price you would not have received in a fast market, a thin market or a price gap.
- Markets change. Volatility, liquidity and trends shift over time, and conditions that suited a method may not return.
- One test covers one slice. Results for one market, one timeframe and one period say little about any other market, timeframe or period.
- Position sizing is modeled too. A fixed risk per trade assumes every stop is filled exactly and every position can be sized precisely, which real accounts often cannot do.
About the backtests on our website
The backtests shown on nexalgo.com are NexAlgo’s own in-house simulations. We ran them as an internal check before releasing the indicators. They are not the results of any customer and not records of real trades.
The published Nexalgo Ignition backtest used the indicator’s default settings, 1% risk per trade and fees of 0.2% per round trip. The symbol, timeframe, exchange whose price data we used, test period and number of trades are shown with the backtest on our website.
Other settings, markets, timeframes, periods, costs or data would give different results. If an indicator is updated after a test, the published results may not reflect the current version.
The backtests show how the indicator behaved under the stated conditions. They are not a forecast or a promise. Your Subscription gives you the indicators; the Service does not include a backtesting tool.
Past performance is no guarantee
Past results, simulated or real, do not guarantee or predict future results. Real results will differ from simulated results and can be much worse.
No one can promise that you will make money with the Service, and we do not. You can lose money even if you use the indicators exactly as our guides describe.
Testimonials
Testimonials on our website are quoted word for word from customers. Each one describes one person’s own experience. They are not typical results, your experience may be very different, and a testimonial is not a promise of what you will achieve.
If a customer received anything for a testimonial, for example free or discounted access, we say so next to it.
Guides, community and chart analysis
Guides, documentation, strategy playbooks and the weekly chart analysis explain how the indicators work and show example ways to read a chart. They are educational, the same for every subscriber on the same plan and not tailored to anyone’s account or situation.
Examples in them are picked to illustrate a point. They are not a representative record of how often a setup works.
Posts, charts and trade ideas from other members on Discord are their own views, not NexAlgo’s, and are not advice. Do not act on them without your own judgment.
NexAlgo will never ask for your passwords, private keys or access to your trading accounts, and will never offer to trade or manage money for you. Treat anyone who does, even if they claim to be from NexAlgo, as a scammer.
Your decisions are yours
You alone decide whether, when and how to trade, and you alone are responsible for the results. Before you trade, think about your financial situation, your goals, your experience and how much loss you can bear.
If you are unsure whether trading, or a particular instrument, is right for you, speak to an independent, licensed financial adviser before you act.
Local laws and taxes
Some instruments, including leveraged products and crypto assets, are restricted or banned in some countries. You are responsible for making sure your trading is legal where you live and for any taxes on your trading results.
Your confirmation
By creating an account, buying a Subscription or using the Service, you confirm that you have read and understood this Risk Disclosure, that you use the Service for educational purposes and at your own risk, that you will not rely on it as financial advice, and that you alone are responsible for your trading decisions and their results.
Our liability
To the fullest extent the law allows, NEXALGO LLC and its members, managers, employees and contractors are not liable for any trading loss, lost profit or other damage that results from your use of the Service, from signals, levels or alerts, or from third-party platforms and data. The full terms on warranties and liability are in our Terms of Service and apply to this Risk Disclosure.
Nothing in this Risk Disclosure limits rights you have under laws that cannot be excluded by contract, such as consumer protection laws in your country.
Changes to this disclosure
We may update this Risk Disclosure. We will publish the new version on this page and change the date at the top of this page. Because this disclosure forms part of our Terms of Service, we tell subscribers about significant changes in the same way as about changes to the Terms (section 19 of the Terms of Service).
